In a victory for those who suffer personal injury due to medical negligence, the Missouri Supreme Court threw out the $350,000 cap on non-economic damages (such as for pain and suffering) in Missouri medical malpractice cases. Under the old cap it did not matter whether you suffered permanent harm such as the loss of a leg or arm due to a medical provider’s negligence, the most you could recover for physical pain and emotional suffering was $350,000.
